12 points within 12 months can suspend your Florida license for up to 30 days, and a review request doesn't automatically pause that suspension, according to Florida Statutes section 322.27. That's the fact most drivers miss. They count the points on one ticket, file paperwork, and assume they're protected.

You're not protected by paperwork alone. You have to check two things at once, the point value and the calendar. Points on a Florida drivers license only trigger a suspension inside specific windows, and those windows run from conviction dates. A ticket that looks small on its own can push you over a threshold if your prior convictions sit inside the same window.

Don't pay first and calculate later. Match the violation code on your citation to its point value, pull your conviction dates, and count what's inside each window. That order decides whether you should pay, contest, or elect a course. Get it backwards and you may create the conviction that suspends you.

Table of Contents

Florida Point Values for Common Violations

A ticket's point value depends on the violation and, for speeding, how far above the limit you were driving. Match the statute number on your citation to the right row before you decide whether to pay or contest it.

Speeding 1 to 15 mph over the limit

3

Speeding more than 15 mph over the limit

4

Speeding 50 mph or more over the limit (super speeder)

Match the Citation Code to the Row

The statute number on your citation identifies the charge. Speeding falls under section 316.183, Florida Statutes. Careless driving falls under section 316.1925 and carries 3 points. Following too closely falls under section 316.0895 and carries 3 points.

Reckless driving is more serious: section 316.192, Florida Statutes, makes it a criminal charge that can mean jail time, a criminal record, and 4 points on your license. Speeding at 100 mph or more, or 50 mph over the limit, can qualify as a super speeder charge under section 316.1926. Ticket Shield defends these Florida charges, which can put your driving privileges at risk.

Practical rule: Read the statute number on your ticket, then match it to the violation. The fine does not tell you how many points the conviction adds.

Why the Same Ticket Type Can Cost You Differently

For speeding, the number of miles per hour over the limit determines the point band. Check the speed alleged on your citation against the row, not just the general label “speeding.” The conviction date matters too: a point value counts within the 12-, 18- and 36-month windows based on conviction dates, so check your calendar as well as the chart.

A stop sign ticket means 3 points on your license. See our guide to stop sign ticket points in Florida for more on that violation. Three points may not trigger a suspension alone, but they can add to points from other convictions within the applicable window.

Before responding, write down the statute number, the alleged speed if the citation is for speeding, and the conviction dates for your other tickets. Use those details to assess the point value and its timing before choosing what to do.

Suspension Thresholds and How Long Points Stay

Florida doesn't suspend you on a lifetime tally. It suspends you on points plus time. That distinction protects some drivers and catches others who thought old tickets no longer mattered.

Up to 3 months

No point-based suspension

The Florida Department of Highway Safety and Motor Vehicles points page states that 12 points within 12 months brings a 30-day license suspension, 18 points within 18 months brings a three-month suspension, and 24 points within 36 months brings a one-year suspension. The same page states that points generally remain on your driver record for at least five years from the conviction or disposition date. Florida also applies the same point totals when the relevant conviction occurs out of state or in federal court.

The Windows Overlap and the Points Reuse

Under Florida Statutes section 322.27, the Department may suspend a license when recorded convictions reach 12 points within 12 months, 18 points within 18 months including points used for the earlier threshold, or 24 points within 36 months. Read that middle row carefully. Points that already counted toward the first threshold can count again toward the second.

Several minor convictions close together can cross a line that no single ticket would cross. Four separate 3-point convictions inside one year reach the first threshold even though each ticket looked routine when you paid it. That's the cumulative trap, and it's why paying quickly without checking your record is a mistake.

Your ticket date starts your response deadline, but your conviction date drives the suspension math. Don't mix the two dates.

Walk One Record Through the Calendar

Say your record shows a conviction on March 10 for 3 points, a second on July 22 for 4 points, and a third on November 5 for 3 points. You're at 10 points inside 12 months. One more 3-point conviction before the following March puts you at 13, past the first threshold, even though the new ticket alone is small.

Now extend the view. Mark 18 months from March 10 and add every conviction inside that span, including the ones you already counted. Then mark 36 months and add again. A driver who stays under the 12-month line can still cross the 36-month line through steady, spaced-out convictions.

Finally, note the aging date for each entry. Each conviction stays on the record for at least five years from its disposition date, so the March conviction doesn't age past five years until March five years later. Write that date beside each line on your record.

Check every window before you answer a new ticket. If any window is close to a threshold, your response choice isn't administrative, it's protective. You need a strategy that keeps a new conviction off the record if one is available.

Pay, Contest or Elect a Course Compared

You have three paths on a Uniform Traffic Citation. They don't produce the same record, so don't treat them as interchangeable ways to close the file.

The FLHSMV driver improvement courses FAQ states that you may pay the civil penalty, contest the citation, or elect a driver-improvement course when eligible, that the election must be made within 30 days, and that failure to elect on time may lead to additional fines and suspension of the driving privilege. It also states that paying the civil penalty is treated as a conviction, with points assessed when the violation is one for which points apply.

What Each Choice Does to Your Record

Paying is fast and final. You close the citation, but you accept a conviction and the points that come with it. If you're near a suspension window or worried about insurance, that speed costs you.

Contesting puts the outcome in front of the court. You're convicted and assessed points only if you're found guilty, which means contesting preserves the chance of a clean result that payment gives away. Our breakdown of how to fight a traffic ticket in Florida explains how that process works in practice.

Electing a course, when you're eligible and you complete it properly, can withhold adjudication and keep points off that violation. It isn't automatic and it isn't available for every citation or every driver. Eligibility decides whether this row in the table is even open to you.

Paying closes the ticket. It doesn't close the consequences.

The Deadline Decides Before the Merits Do

Count 30 days from the date you received the citation and mark it today. If you let that date pass while you think it over, you can lose the course election and face added fines and a suspended driving privilege. Indecision is itself a decision, and it's usually the worst one.

Use this decision rule. Compare the deadline and the conviction outcome for each path before you pay anything. If a path avoids a conviction and you're eligible for it, take that path seriously before the calendar removes it.

Driver Improvement Course Rules and Exceptions

An election can keep points off one violation, but only if you qualify and complete every required step. Check the rules before enrolling.

A three-step infographic showing the process for electing to take a Florida driver improvement course.

The FLHSMV Basic Driver Improvement course page says you must elect the course within 30 days after receiving the citation. If you complete it properly, adjudication is withheld under section 318.14, Florida Statutes, and no points are assessed for that violation. You may generally elect the course once during any 12-month period.

The Election in Five Steps

  1. Confirm eligibility first: Check whether your citation qualifies and whether your course history allows another election. Do this before enrolling.

  2. Elect within 30 days: The deadline runs from the date you received the citation.

  3. Enroll in an approved course: Choose an approved Basic Driver Improvement provider. See the guide to Florida traffic violator school for how approved courses fit into a ticket case.

  4. Complete the course: Finish all required work. Partial or improper completion does not qualify for the no-points result.

  5. Verify the outcome: Check that no points were assessed for the violation. Keep your completion records.

Exceptions That Sit Beside the Steps

Course eligibility has exceptions. The FLHSMV Basic Driver Improvement course page lists a second infraction within 18 months, a third infraction within 36 months, and exceeding the speed limit by more than 15 miles per hour among the situations that can make a driver ineligible.

Check before you enroll: Compare the citation date and your course history with the eligibility rules.

A course election is limited, not a reset. Use the calendar as well as the course-history rules: point totals are measured within 12-, 18- and 36-month windows that run from conviction dates. If you are eligible, weigh the course against contesting the citation before committing your election. If an exception applies, check your other options before the 30-day deadline passes.

Teen Drivers, Insurance and Non-Fine Costs

A 17-year-old with two moving-violation convictions in one school year can face a driving restriction, not just fines. The lost flexibility can disrupt school, work, and family schedules.

A concerned mother speaks to her teenage son sitting in the driver's seat of a car.

The Teen Threshold Is Half the Adult Threshold

The FLHSMV teen drivers page states that a driver under age 18 who receives 6 or more points within a 12-month period is automatically restricted to driving for “Business Purposes Only” for one year, or until reaching age 18, whichever occurs first, under section 322.161, Florida Statutes. Each additional point received during the restricted period extends it by 90 days.

Six points is half the adult threshold. The restriction narrows lawful driving to qualifying business purposes, including travel for employment, education, and medical care. A conviction can therefore affect a teen's routine well beyond the cost of the citation.

Costs That Never Appear on the Citation

A conviction can bring costs and practical consequences beyond the fine. The short video below covers those added costs.

Consider these costs for any driver in your household:

  • Insurance premiums: A conviction can affect what you pay at renewal. Read about how a speeding ticket can affect your insurance and ask your insurer how it would rate the violation on your policy.

  • Lost time: Court dates and hearings can take a driver or parent away from work or class.

  • Restricted commuting: A Business Purposes Only restriction can limit how a teen travels to a job.

  • Daily disruption: A course requirement or suspension can complicate a family's routine.

Insurers set their own rates, so ask your carrier for the likely effect on your policy. Put that estimate beside the fine before deciding how to handle the citation. For families also working on safer habits, safe driving guidance for teenage learners offers general advice for young drivers.

Confirm Your Point Count Before Any Deadline

A point total only matters inside the 12-, 18- and 36-month windows measured from conviction dates. Check your record and calendar before choosing what to do about a new citation.

Your Three-Step Checklist

  • Pull your official record: Use this guide to check your Florida driving record for points. List each conviction date.

  • Mark your election deadline: Put the deadline shown on your citation on a calendar you check regularly.

  • Match the violation to the table: Confirm the statute number and point value for your specific charge.

Now total the points that fall within each window, counting from the conviction dates. If a new conviction could push you over a suspension threshold, treat the ticket as a license risk, not a routine payment.

A points check takes minutes. A suspension can disrupt your ability to drive to work.
